The City of Hot Spring's can exercise substantial
control (the law is currently selectively enforced here & there, now & then) of
real estate matters in the large "Extra-Territorial Jurisdiction" outside the
city limits. Look at the HS Planning Area Map
to see if you are in it. Residents of this vast area outside city limits
don't receive city services, and they cannot vote in city elections. Still the city prohibits, controls, &
regulates the sale of real estate parcels between private parties,
and those who don't conform to city requirements are guilty of criminal
conduct. You could be prosecuted, fined, and jailed for recording a
deed! Help persuade the City Directors to remedy this condition. A
majority vote of four (4) is all it takes to revoke the provisions of the
City Code that authorize City Planning Department control & regulation of real estate matters outside the city
limits. Surely the City has enough on it's plate tending to the concerns
of approx. 35,000 citizens INSIDE the municipal boundaries without
intruding itself into the business of approx. 58,000 souls OUTSIDE the
city but unfortunately in it's "Planning
Area".
